Terms and Conditions

These Terms & Conditions apply to the use of michiel.com.au and to purchases from MICHIEL JEWELLER. Please read them together with our Shipping & Delivery Policy, Return Policy, Privacy Policy and Jewellery Care Guide

About MICHIEL

MICHIEL JEWELLER is operated by GRAYLINE DEVELOPMENTS PTY LTD (ABN 16 692 880 372). In these terms, “MICHIEL”, “we”, “us” and “our” refer to that business trading as MICHIEL JEWELLER.

Website use

You may use this website for lawful personal shopping and information purposes. You must not misuse the website, interfere with its operation, attempt unauthorised access, introduce malicious code, scrape content at scale, or use MICHIEL content in a way that infringes our rights or the rights of others.

Product information

We aim to describe and photograph our jewellery accurately. Colours and finishes may appear slightly different depending on screens, lighting and photography. Dimensions, weights and handcrafted or finishing details may also
vary within reasonable manufacturing tolerances. Nothing in this section permits MICHIEL to supply a product that materially differs from its description or otherwise fails to meet applicable consumer guarantees.

Prices, GST and payment

Prices are displayed in Australian dollars unless stated otherwise. Prices include Australian GST where applicable. Any delivery fee, tax or charge collected by MICHIEL will be shown before payment. Online card payments are processed through Stripe. By placing an order, you confirm that you are authorised to use the selected payment method and authorise the payment required for the order.

Orders and acceptance

Submitting an order is an offer to purchase the selected products. An automated order acknowledgement does not prevent us from checking payment, stock availability, pricing or suspected fraud before accepting and fulfilling the
order. We may decline or cancel an order before dispatch where reasonably necessary, including because of a genuine stock error, obvious pricing error, failed or reversed payment, suspected fraud, misuse of a promotion or an inability to lawfully supply the order. If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.

Stock availability

Products are subject to availability. If an item becomes unavailable after you order, we will contact you and, where practical, give you the option to wait for restock or receive a refund for the unavailable item. We will not substitute a different product without your agreement.

Order changes and cancellations

If you want to change or cancel an order, contact care@michiel.com.au as soon as possible. We may be able to assist where fulfilment has not progressed, but cancellation or amendment is not guaranteed. Once an order has been processed for dispatch or dispatched, it cannot be cancelled through the order-cancellation process. Our Return Policy will then apply to any eligible change-of-mind return. Nothing in this section limits rights relating to faulty or non-compliant goods.

Shipping and delivery

Shipping destinations, charges, processing times, estimated delivery periods, tracking, signature requirements, address responsibilities, New Zealand import charges and missing-parcel procedures are set out in our Shipping & Delivery Policy, which forms part of these terms.

Returns, refunds and product problems

Our Return Policy explains our voluntary 30-day change-of-mind process, return-condition requirements, refund processing and how faulty, damaged or incorrect items are handled. Nothing in these terms or our Return Policy excludes rights that cannot lawfully be excluded under the Australian Consumer Law or other applicable consumer law.

Product care, plating and normal wear

MICHIEL jewellery requires appropriate care. Unless otherwise stated on a product page, pieces are made from 925 sterling silver with rhodium plating, with selected pieces featuring moissanite pavé. Rhodium plating is a surface finish and may gradually wear with friction, perspiration, chemicals and normal use. Sterling silver can also oxidise or tarnish over time.

Fine scratches, surface marks, gradual plating wear, oxidation, tarnishing and changes in polish can occur with normal wear and are not automatically manufacturing faults. Damage caused solely by accident, misuse, improper storage, inappropriate cleaning, excessive force, third-party alteration or continued wear after damage becomes apparent is assessed differently from a manufacturing fault. For detailed maintenance and storage instructions, please refer to the MICHIEL Jewellery Care Guide.

Signature open-hook clasp

The MICHIEL signature clasp is an intentional open-hook closure and is not a mechanical locking clasp or secondary safety clip. Before wearing a necklace or bracelet, the hook must be fully inserted and correctly seated through the intended link. Pulling, snagging, twisting, sleeping in the jewellery, strenuous activity or other pressure on the chain can cause an open-hook closure to disengage. Customers should follow the fastening and care instructions in the Jewellery Care Guide and stop wearing a piece if the hook, receiving link or surrounding structure appears bent, cracked, distorted or otherwise damaged.

MICHIEL does not provide complimentary replacement for accidental loss caused solely by improper fastening, snagging, misuse or accidental damage where no product fault contributed. If a customer believes a manufacturing or product fault contributed to a loss or failure, MICHIEL may request information reasonably necessary to assess the circumstances. Nothing in this section limits rights under applicable consumer law.

Intellectual property

The MICHIEL name, logos, jewellery designs, product photography, graphics, text and other website content are owned by or licensed to MICHIEL unless stated otherwise. They may not be reproduced, adapted, distributed, commercially used or presented as another person’s work without permission, except where law permits.

Promotions and discount codes

Promotions and discount codes are subject to any conditions displayed with the offer, including validity dates, eligible products and whether codes can be combined. We may refuse use of a promotion where it is expired, used contrary to its stated conditions, affected by an obvious error or reasonably suspected of misuse.

Liability and consumer rights

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded. To the maximum extent permitted by law, MICHIEL is not responsible for loss caused solely by events outside our reasonable control, customer misuse, incorrect information supplied by the customer, or use of the jewellery contrary to clearly provided care and safety instructions. This limitation does not apply where MICHIEL is legally responsible for the loss or where liability cannot lawfully be excluded.

Governing law

These terms are governed by the laws of Western Australia, Australia. This does not remove any mandatory consumer rights that apply to a customer in another jurisdiction, including where New Zealand consumer law applies to a New Zealand customer.

Changes and contact

We may update these terms for future use of the website and future orders. The version applicable when an order is
placed will generally apply to that order unless a lawful change is agreed or required. Questions about these terms
can be sent to care@michiel.com.au.
